United States
The Reconstruction Amendments expressly granted Congress enforcement power, but federalism, state immunity, judicial doctrine and limits on causes of action can determine whether relief is available.
Germany
Fundamental rights bind all state authority directly. Judicial recourse and constitutional complaint provide important routes, but admissibility requirements, statutory limitations and judicial interpretation still shape practical protection.
Does a constitution merely prohibit the government from discriminating, or can it also require the government to protect people from foreseeable harm?
